Terms and ConditionsÂ
Information on how to enter and prize form part of these Terms and Conditions. Participation in the Promotion is deemed acceptance of these Terms and Conditions. Â
Overview
1. Eligible participants will go into a draw to win one of ten Visa gift cards valued at $200 each.
Promoter
2. The Promoter is InvestSMART Financial Services Pty Ltd, ABN 70 089 038 531 AFSL 226 435 of Level 2, 66 Clarence Street, Sydney NSW 2000 (Promoter).
Promotion Period
3. The Promotion commences at 12:00am AEST on Thursday 27 June 2024 and closes at 11:59pm AEST on Wednesday 10 July 2024 (Promotion Period). The Promoter may extend or shorten the Promotion Period by giving notice of any such extension or shortening on the InvestSMART website (www.investsmart.com.au).
How to enter
4. To enter the Promotion, log into your account and tell us that you want to participate in the Promotion by completing the form on the Promotion webpage.
5. The Promoter reserves the right to verify the validity of entries and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe have breached any of these Terms and Conditions.
How the winner will be chosen and notified
6. A draw will take place at 11:00am AEST on Thursday 11 July 2024. The draw will take place at Level 2, 66 Clarence Street, Sydney NSW 2000 using an authorised random draw service.
7. The winners’ will be notified by email on Friday 12 July 2024. The winners’ name will be published on the Promoter’s website from Friday 12 July 2024.
8. The Promoter’s decision is final and no correspondence will be entered into.
Prizes
9. There will be ten winners chosen at random using an authorised random draw service. Each winner will receive a Visa gift card valued at $200. Total value of the prize pool is $2,000.
10. A Visa gift card will be posted to each winner by registered mail and is valid until the date shown on the card.  The Visa gift card is subject to its terms of issue and may not be accepted by all retailers. The Promoter accepts no liability for a defective card however, if necessary, will provide reasonable assistance to the winner to ensure a replacement Visa gift card is provided.
11. Any ancillary costs associated with redeeming the Visa gift card are not included. Any unused balance of the Visa gift card will not be awarded as cash. Redemption of the Visa gift card is subject to any terms and conditions of the issuer including those specified on the Visa gift card.
12. No cash alternative or alternative prize can be offered. 
Prizes
13. If a prize remains unclaimed after three calendar months of the original prize draw, the Promoter will conduct a further draw for those prizes, subject to any directions from any regulatory authority. The unclaimed prize draw will be conducted at the same time and place as the original draw. The date for the additional draw would be on Monday 14 October 2024.
14. The winner/s of the unclaimed prize draw will be notified by telephone within two (2) days of the draw. The name/s of the unclaimed prize draw will be published on the Promoter’s website the day following the unclaimed prize draw. 
General information

16. Participants consent to the Promoter using their name, town of residence and likeness in any social media and on the Promoter website for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
17. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
18. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including their respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: any technical difficulties or equipment malfunction (whether or not under the Promoter’s control).
19. The Promoter may collect personal information (PI) in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed here
20. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Participant. The Privacy Policy also contains information about how Participants may opt out, access, update or correct their PI, how Participants may complain about a breach of the Australian privacy laws or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose Participant’s personal information to any entity outside of Australia.
21. This competition is governed by the laws of NSW.
