Terms and Conditions
Information on how to enter and prize form part of these Terms and Conditions. Participation in the Promotion is deemed acceptance of these Terms and Conditions.
Overview
1. Eligible participants will go into a draw to win a $10,000 investment portfolio of their choice in the InvestSMART Professionally Managed Account ARSN 620 030 382 (PMA). Authorised under ACT Permit No. TP 24/01106 and SA Permit No. T24/833
Promoter
2. The Promoter is InvestSMART Financial Services Pty Ltd, ABN 70 089 038 531 AFSL 226 435 of Level 2, 66 Clarence Street, Sydney NSW 2000 (Promoter).
Promotion Period
3. The Promotion commences at 12:00am AEST on Monday 19 August 2024 and closes at 11:59pm AEST on Wednesday 23 October 2024 (Promotion Period). Subject to the approval of the relevant authorities, the Promoter may extend or shorten the Promotion Period by giving notice of any such extension or shortening on the Promotion website (www.TestYourInvestSmarts.com.au).
How to enter and eligibility
4. To enter the Promotion, an entrant must, during the Promotion Period visit the Promotion website (www.TestYourInvestSmarts.com.au) and complete the “Test Your Invest Smarts” quiz. Participants will also be required to either:
(a) subscribe to the InvestSMART free newsletter by submitting their name and email address; or
(b) if the participant is already subscribed to the InvestSMART free newsletter, they must register their interest in participating in the Promotion by submitting their name and email address on the Promotion website.
By doing so, the participant will automatically gain one (1) entry into the Promotion.
5. Entry to the Promotion is open to Australian residents in all eligible states/territories who fulfil the method of entry requirements described above and are 18 years of age or older. One entry per person. To receive the prize, the winner must be able to nominate a bank account with an Australian deposit-taking institution and successfully pass any identity checks relating to the Anti-Money Laundering and Counter-Terrorism Financing Act (AML/CTF). If the winner cannot complete the PMA application process, then the winner will not be able to receive the prize, no alternative prize will be offered and the procedure in paragraph 12(c) of these Terms and Conditions will apply.
6. The Promoter reserves the right to verify the validity of entries and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe have breached any of these Terms and Conditions.
How the winner will be chosen and notified
7. There will be one winner only.
8. A draw will take place at 11:00am AEST on Thursday 24 October 2024. The draw will take place at Level 2, 66 Clarence Street, Sydney NSW 2000 using an authorised random draw service.
9. The winner will be notified by email on Friday 25 October 2024. The winner’s name will be published on the Promotion website (www.TestYourInvestSmarts.com.au) from Friday 25 October 2024.
10. The Promoter’s decision is final and no correspondence will be entered into.
Prize and conditions
11. The prize is one (1) AU$10,000 investment portfolio of the winner’s choice within the InvestSMART PMA. The winner can choose one investment portfolio from the portfolios listed in the InvestSMART PMA Investment Menu. The Product Disclosure Statement, Investment Menu and Target Market Determination are available on the InvestSMART website. If the winner needs limited personal financial advice in relation to which investment portfolio may be suitable for them, then the winner will be directed to complete the online investment questionnaire and obtain an InvestSMART Statement of Advice. Other than the InvestSMART Statement of Advice, the InvestSMART website and all communications with InvestSMART (in any form or manner) will constitute general financial advice only.
12. The following conditions apply:
(a) There will be one winner chosen at random using an authorised random draw service on Thursday 24 October 2024.
(b) The winner must complete an online PMA Investment Application on or before Thursday 14 November 2024. Successful completion of an online PMA Investment Application includes satisfactory completion of identity verification for AML/CTF purposes and provision of a bank account with an Australian deposit-taking institution.
(c) If the winner does not successfully complete the online PMA Investment Application before Thursday 14 November 2024, then the prize will be deemed an unclaimed prize. In this case, a second draw will be conducted at 11:00am AEST on Monday 18 November 2024 (Secondary Prize Draw). The Secondary Prize Draw will take place at Level 2, 66 Clarence Street, Sydney NSW 2000 using an authorised random draw service. The Secondary Prize Draw winner will be notified by email on Tuesday 19 November 2024 and their name will be published on the Promoter’s website from Tuesday 19 November 2024.
(d) The Secondary Prize Draw winner must complete an online PMA Investment Application on or before Tuesday 10 December 2024. Successful completion of an online PMA Investment Application includes satisfactory completion of identity verification for AML/CTF purposes and provision of a bank account with an Australian deposit-taking institution.
(e) If the Secondary Prize Draw winner does not successfully complete the online PMA Investment Application before Tuesday 10 December 2024, then the prize will be deemed an unclaimed prize and there will be no further prize draw. Instead, the Promotion will be cancelled.
13. By claiming the prize, the winner:
(a) agrees to the InvestSMART website terms and conditions;
(b) agrees to the InvestSMART Privacy Policy;
(c) confirms they have read and understood the PMA Product Disclosure Statement and Target Market Determination.
14. The prize is valued at $10,000 on the date that the investment portfolio is issued to the winner. All investments have an inherent level of risk and InvestSMART makes no guarantee in relation to the future value of the prize. No cash alternative or alternative prize can be offered.
General information
15. If, for any reason, the Promotion is not capable of running as planned, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the Promotion at any time by giving notice of such cancellation, termination, modification or suspension on the InvestSMART website.
16. Participants consent to the Promoter using their name, town of residence and likeness in any social media and on the Promoter website for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
17. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
18. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including their respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: any technical difficulties or equipment malfunction (whether or not under the Promoter’s control).
19. The Promoter may collect personal information (PI) in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://cdn-blob.investsmart.com.au/documents/IS_Privacy_Policy.pdf
20. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Participant. The Privacy Policy also contains information about how Participants may opt out, access, update or correct their PI, how Participants may complain about a breach of the Australian privacy laws or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose Participant’s personal information to any entity outside of Australia.
21. This competition is governed by the laws of NSW.
22. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, or suspend or modify a prize, subject to State or Territory regulation.
